Man accused of rape of a woman detained under a hospital order

A mentally ill man has been given a hospital order over a rape allegation. A special hearing took place to to decide whether or not the allegation was true at Nottingham Crown Court.

A jury returned a finding of fact verdict that “he did the act” after he did not have the mental capacity to enter a plea or attend a trial. Sentencing Benjamin White, previously of Carlton Road, Carlton, Judge Rosalind Coe gave him a hospital restriction order without limit of time and he is now at Highbury Hospital, Bulwell.

The 37-year-old was sentenced in his absence on Wednesday, June 15. The alleged victim was distressed by White’s behaviour, which was mainly as a result of his illness, after the incident on September 8, 2018, in Bulwell.

Doctor Hasanen Al-Taiar spoke over a link to the courtroom to say the defendant has schizophrenia and a chronic disturbance of his thought process. “He lacks insight into his illness and the need to receive medications,” he added.

The judge said: “I am satisfied he suffers from a mental disorder and it is appropriate to be detained in hospital for medical treatment”.
